Legal information of the web portal 

VidaCaixa, S.A.U. de Seguros y Reaseguros (hereinafter "VidaCaixa") is the owner of the VidaCaixa portal or the website you have accessed.

Access to the portal or to any of the VidaCaixa websites and to the information relating to any of the products and services contained therein implies acceptance of the general terms set forth in this Legal Notice. For this reason, you must read its content carefully if you wish to access and make use of the information and services offered on the portal or any of the VidaCaixa websites.

Validity of the information

The information contained in this document is current as of the date of the last update.

These terms and conditions are those in effect as of the date of their last update. VidaCaixa reserves the right to modify them at any time, in which case they will come into force as soon as they are published and will be applicable to all users of the portal or websites from that date on.

The contents of any of the web pages, especially information and advertising, unless expressly stated otherwise, do not constitute a binding offer. VidaCaixa reserves the right to introduce modifications or partially or totally omit the current contents when it considers it appropriate, as well as to temporarily or permanently prevent or restrict access.

VidaCaixa may include third party content and links to third party webpages in any of its websites, always with the authorisation of their owners, such as social media platforms and other information. In none of these cases will VidaCaixa be responsible for the pages and contents of third parties, nor for the operation and availability thereof.

Procurement of products and services

Taking out the VidaCaixa products and services that are available at any time on the website (hereinafter “the products and services”) will be done with the mediation of CaixaBank, S.A. (hereinafter “CaixaBank”), in its capacity as the banking insurance operator of VidaCaixa. 

Therefore, users should have the identification and signature systems available that CaixaBank requires in each case. 

The procurement of products and services shall require, as an essential condition, the prior agreement to the contractual terms of the product or service in question. 

The user is informed and accepts that the information contained in the website on the formalisation of products or services does not imply an offer or the beginning of a business relationship with VidaCaixa, but that compliance with the requirements established in each of these contractual documents in accordance with the applicable regulations will be required in any case. 

Browsing and customisation

Simple browsing through the VidaCaixa websites is free of charge and does not require prior registration by the user. However, accessing, procuring or using some products or services may require the user to register. In such case, each such product and service shall be governed by its own specific terms and conditions, without prejudice to the terms and conditions set forth herein.

In some of the portals or websites, users will be offered the possibility of customising the pages, including different screen backgrounds or configuring access to their favourite products and services, making browsing and the location of the resources used efficient and functional, and therefore adapting them to the tastes and uses of each user.

Blog participation information

By participating in the VidaCaixa blog hosted on the Website, the user will be solely responsible for the messages they post on it. VidaCaixa is not liable for any claim that may arise in relation to any comment you may make on the website. 

In order to maintain a pleasant environment for all, the user shall observe and comply with the information contained in these points. 

VidaCaixa reserves the right to publish the comments sent by the user or even to eliminate comments that: 

(i) Are defamatory, libellous, false, misleading, unfounded or unsubstantiated; insulting, threatening or rude, obscene, sexually explicit, racist, provocative, sexist, homophobic, or otherwise discriminatory or objectionable. This includes words that include asterisks, numbers or other characters in place of some of their letters. 

(ii) Are not considered to be related to the subject matter of the blog or the website. 

(iii) Include contact information and/or personal data, such as telephone numbers, postal or email addresses, bank accounts, etc. 

(iv) Promote products or services of third parties. 

(v) May be considered to represent the use of electronic messaging systems to send unsolicited messages indiscriminately (spam). 

(vi) Are in any way illegal or do not comply with all the regulations established in these general terms of access and use or in any other policy of use of the VidaCaixa website. 

(vii) Infringe, directly or indirectly, the rights of VidaCaixa or third parties, including the violation of industrial and intellectual property rights, commercial secrets, know-how, and the right to honour, privacy and personal image. 

(viii) Intend to impersonate another user or pretend to be someone else. 

(ix Include links to other websites and/or originate from a user name the content of which infringes these points and other instructions or regulations concerning the blog and the website. 

(x) The user shall respect other users at all times. The user shall be tolerant and respectful of the messages and opinions of other users. Messages that may be considered harmful to the rights of third parties or that may be detrimental to the peaceful undertaking of the blog may be deleted.

(xi) VidaCaixa may reproduce, modify or disseminate the messages published in the blog in the terms and using the means it considers most appropriate, without the user being entitled to any type of compensation. 

VidaCaixa is not responsible for what is published in the blog, nor does it guarantee the veracity or accuracy of any information published therein. The sender of messages or information is responsible for their content. We do not guarantee the availability or continuity of the blog, and we may modify, suspend or remove it without prior notice at any time. 

In the event that the user considers that they are being affected by illegal actions or action contrary to this policy, or detects misuse of the blog by other users, they may notify VidaCaixa by emailing blog@vidacaixa.es indicating "blog moderation" in the subject, so that we can adopt the measures we consider most appropriate. 

In all cases, the user will hold VidaCaixa harmless against any claim that may be presented by another user for the messages they may have posted on the blog or for any other conduct linked to or derived from the use of the blog.

The VidaCaixa portal and websites have the necessary security and quality certificates, seals or accreditations to offer users a secure environment. However, we recommend that you check and carefully read the Security Recommendations that VidaCaixa provides all users on its portal.

Physical supports (start-up disk)

  • It is important not to keep your backup copy in the same place as your computer as you could lose them both if there were to be an accident.
  • It is strongly recommended that you always keep a start-up disk to hand and, if necessary, the operating system to install. If you do, you can sometimes correct an error or at least save any new information not saved in the last backup copy.
  • You must create a new start-up disk every time that you perform a critical system update.
  • Also keep the installation CD handy in case errors cannot be corrected and the system must be reinstalled.

Software versions (Operating system)

You should also keep your operating system and software up-to-date, installing the recommended updates.

Manufacturers often update their software as errors are detected once it is in widespread use. They also enhance security measures, so all recommended updates should be installed to keep the system stable and secure from potential attacks.

Privacy and data protection policy

VidaCaixa fully complies with current legislation on the protection of personal data and with the confidentiality commitments inherent to banking activity.

VidaCaixa has adopted the necessary technical measures to maintain the required level of security, according to the nature of the personal data processed and the circumstances of the processing, in order to avoid, as far as possible and always according to the available technology, their alteration, loss, unauthorised processing or access.

When the completion of a form is requested in which personal data is collected, the customer or user will be informed of the recipient of the information, the purpose for which the data is collected, the identity and address of the person responsible for the file and the user's right to exercise their rights of access, rectification, cancellation and opposition to the processing of their data. The personal data collected will only be processed and/or transferred for the aforementioned purpose and always with the consent of the user or customer.

So that the information contained in our files is always up to date and does not contain errors, we ask our customers and users to inform us as soon as possible of any modifications or corrections to their personal data.

Cookies policy

The VidaCaixa web pages have cookies, which are small data files that are stored in the user's or client's computer and that can allow our systems to remember characteristics or preferences of the browsing of our web pages that can be used to personalise access on subsequent visits, make browsing safer, gather statistical information on the browsing carried out or find out user preferences.

VidaCaixa's cookie policy is subject to current EU and Spanish legislation on the processing of personal data and the protection of privacy in the electronic communications sector. Mobile portals and geolocation

Some of the VidaCaixa web pages are adapted for use on mobile devices, so it is possible that the presentation and content of the different mobile applications may not match or be exactly the same as those on the portal or the different websites.

Moreover, some of the web pages adapted for mobile devices or applications may have geolocation functions, in order to determine the location of said device at any given moment, when the user activates this feature. This enables you to access the services VidaCaixa offers that require geolocation.

Access to the aforementioned services will require the user to activate the geolocation function on their mobile device, which they may deactivate at any time.

Intellectual and industrial property

The VidaCaixa portal and websites, the pages they include and the information or elements contained therein include texts, documents, photographs, drawings, graphic representations, databases, computer programmes, logos, brands, trade names or other distinctive signs protected by intellectual or industrial property rights, of which VidaCaixa or the companies of the CaixaBank Group are the owners or legitimate licensees.

VidaCaixa does not grant any guarantee regarding the legality or lawfulness of the information or elements contained in the web pages of VidaCaixa in the event that their ownership does not correspond to VidaCaixa or to the companies of the CaixaBank Group.

Prohibited and permitted uses

Any form of exploitation, including any type of reproduction, distribution, transfer to third parties, public communication and transformation, by means of any type of support and medium of the aforementioned works, creations and distinctive signs without the prior and express authorisation of their relevant owners is prohibited. Failure to comply with this prohibition may constitute an infringement punishable by law.

However, users may download or make copies of such elements exclusively for their personal use, at their own risk and provided that they do not infringe any of VidaCaixa's intellectual or industrial property rights. In particular, you may not alter, modify or delete them in whole or in part. Under no circumstances does this imply any authorisation or licence over the property rights of VidaCaixa or the companies of the CaixaBank Group.

It is forbidden, except when expressly authorised by VidaCaixa, to set links or hyperlinks from portals or websites of third parties to web pages of VidaCaixa other than the homepage of its portal, as well as to present the web pages of VidaCaixa or the information contained therein under frames, distinctive signs, brands or company or commercial names of another person, company or entity.

Liability

VidaCaixa does not guarantee continuous access, nor the correct viewing, downloading or use of the elements and information contained in the web pages of VidaCaixa, which may be impeded, hindered or interrupted by factors or circumstances beyond its control.

VidaCaixa is not responsible for the information and other contents integrated in spaces or web pages of third parties accessible from the web pages of VidaCaixa by means of links or hyperlinks, nor for the information and other contents integrated in spaces or web pages of third parties from which the VidaCaixa portal or any of its web pages are accessed by means of links or hyperlinks, nor for the information and contents of any web page of third parties presented under the appearance or distinctive signs of VidaCaixa, unless expressly authorised by the latter.

VidaCaixa and its information providers as third parties do not accept any responsibility in relation to the information, contents of any kind, products and services offered or provided through the web pages of VidaCaixa by third parties or entities, even if they belong to the same financial Group, and, in particular, for damages of any kind that, linked to the above, may be caused by: (i) absence or deficiencies in the information provided to users or in its truthfulness, accuracy and sufficiency; (ii) breach or defective or untimely performance of agreements or pre-contractual relations; (iii) breach of the obligations incumbent on information society service providers; (iv) infringement of the rights of consumers and users; (v) infringement of intellectual and industrial property rights; (vi) infringement of the right to data protection, professional secrecy and the rights to honour, personal and family privacy and personal image; (vii) in general, breach of any applicable laws, customs or codes of conduct and (viii) any decision taken on the basis of the information provided on the VidaCaixa portal.

Neither VidaCaixa nor the information providers as third parties accept any responsibility for damages, losses, claims or expenses caused by: (i) interferences, interruptions, faults, omissions, telephone breakdowns, delays, blockages or disconnections in the operation of the electronic system, caused by deficiencies, overloads and errors in the telecommunications lines and networks, or by any other cause beyond the control of VidaCaixa; (ii) illegitimate intrusions using malicious programmes of any type and by any means of communication, such as computer viruses or any other means; (iii) improper or inappropriate use of the web pages of VidaCaixa; (iv) security or navigation errors produced by a malfunction of the browser or by the use of non-updated versions thereof.

These general terms shall be governed by Spanish law.
